1 Monterey Peninsula Airport District Rules & Regulations For Commercial Ground Transportation The following rules and regulations have been adopted by Resolution 1594, under Ordinances 911 & 912 and supersede all earlier published ground transportation rules and regulations. AUTHORITY 1.0 The Monterey Peninsula Airport District Board of Directors has delegated authority to the Airport Manager, his designee, or Ground Transportation Management personnel to act on its behalf in administering commercial ground transportation at the Airport, regulating the use of the facilities and services of the Airport, determining and collecting use charges therefore, enforcing these Rules and Regulations for commercial ground transportation providers and the general Airport Rules and Regulations, and carrying out such other duties and responsibilities as required to manage ground transportation. 1.1 The following rules and regulations govern the operations of all commercial ground transportation businesses upon the Monterey Regional Airport. Commercial operators of all types are covered, including, but not limited to, the following: (a) Transportation Charter Party Operators (b) Passenger Courtesy Vehicles (Hotel/Motel) (c) Taxicabs 1.2 These Rules and Regulations may be changed at any time by action of the Board of Directors, or without action by the Board of Directors because of requirements imposed by the Federal Aviation Administration (FAA), Transportation Security Administration (TSA), and/or Regional Taxi Authority Rules (RTA) or other state or federal authority at any time and without prior notice. Any changes or additional requirements mandated by the FAA, TSA and/or RTA supersede these Rules and Regulations. DEFINITIONS 2.0 Unless specifically defined otherwise herein, or unless a different meaning is apparent from the context, the following words or phrases have the meanings set forth below. Words or phrases that are not defined in this ordinance, but that are defined in the California Penal Code, have the meanings set forth therein: (a) Airport: means the Monterey Regional Airport and all lands owned and operated by the Monterey Peninsula Airport District for airport purposes or activities. “Airport” includes all improvements, facilities and appurtenances. (b) Terminal: means all buildings and structures located within the airport and open to the public for the purpose of flight ticket purchase, public lobby, waiting, baggage check-in and those other services related to public air travel.

2 (c) Taxicab: Any passenger-carrying vehicle with a maximum seating capacity of seven (7) passengers plus the driver holding a permit issued by the Regional Taxi Authority for transportation of passengers and their baggage in taxicab service operation on a “pre-arranged and on-demand” basis, the first passenger: (1) having exclusive use of the vehicle unless he/she agrees to “Multiple Loading”; and (2) having the ability to designate any destination, route, or stops desired on the route. (d) Limousine/Van/Shuttle: Any passenger-carrying vehicle with a maximum seating capacity of fourteen (14) passengers plus the driver operating on a “pre-arranged and on-demand” basis, transporting passengers at a per-person rate, the use of said vehicle not being exclusive to any individual or group. (e) Bus: Any passenger vehicle with single or dual rear axles capable of carrying fifteen (15) or more passengers not including the driver. (f) Courtesy Vehicle: Any vehicle permitted to transport its customers as a “Courtesy” service only, not for hire/not for compensation. (g) Luxury Limousine: A vehicle for hire on a charter basis which shall offer luxury features including, but not limited to, television, telephone, and beverages and has at least four doors, two on each side of the vehicle (this does not include the front or rear of the vehicle) all of which must be designated for entry and exit by its occupant. Luxury limousine does not include a taxicab. (h) Scheduled Service: The transportation of passengers or property between fixed points and over designated routes at established times as specified in the carrier’s time schedule as filed and approved by the appropriate jurisdictional authority. (i) On Call and Demand/Call and Demand: The transportation of passengers or property not “On Schedule.” (j) Taxi Holding Lot: An area dedicated to queuing of taxi operators prior to being dispatched to the terminal. (k) Taxi Terminal Queuing Area: An area dedicated to queuing of taxi operators at the terminal. (l) TCP/Courtesy Vehicle Holding Lot: An area, if applicable, dedicated to the queuing of TCP and Courtesy Vehicles prior to pre-arranged and on-demand passenger pick-ups at the terminal. (m) Ground Transportation Curbside Management: A person or entity contracted by the Monterey Peninsula Airport District, to manage the queuing, staging and curbside policies set within this document, including applicable policies adopted by the Monterey County Regional Taxi Authority or the California Public Utilities Commission. (n) Sticker Permit: An annual permit for each motor vehicle picking up passengers (and drop- offs for taxicabs) at the airport. (o) Automated Vehicle Identification (AVI) Medallion: A Radio Frequency Identification (RFID) bar code sticker tag used for the purpose of capturing per trip surcharges and other enforcement tracking mechanisms.

3 (p) Airport Surcharge Fee: The amount charged for each passenger(s) pick-up and drop-off per motor vehicle trip. (q) Dwell Time Fee: If applicable, the period of time which a motor vehicle remains upon the loading and unloading areas of the terminal. (r) Cruising: Operation of a motor vehicle upon Airport roadways by a Commercial Operator for the purposes of soliciting or attempting to solicit passengers in any location other than in the loading and unloading areas specifically authorized for such use in these regulations. (s) Ground Transportation Year: The Ground Transportation Year shall run from July 1st through June 30th. (t) Loading and Unloading Areas: Those areas authorized for passenger loading and unloading. (u) Replacement Vehicle: A vehicle intended by a Commercial Operator to replace a vehicle that has been registered for the ground transportation year but was subsequently destroyed or sold. (v) Revocation: The revocation of a Commercial Operator’s privilege to operate motor vehicles on Airport property and/or to otherwise conduct business activities in the Airport Terminal. (w) Solicitation: Any attempt or act by or for a Commercial Operator, direct or indirect, verbal, non-verbal or written, of whatever nature to obtain passengers or baggage. (x) Suspension: The temporary discontinuance of a Commercial Operator’s privilege to operate motor vehicles on the Airport and/or to conduct business activities in the Airport Terminal. COMPLIANCE 3.0 Commercial Operators conducting business activities upon Airport premises shall comply with all laws of the United States and the State of California, all rules and regulations promulgated by the Monterey County Regional Taxi Authority or the California Public Utilities Commission, the Federal Aviation Administration (FAA), the Transportation Security Administration (TSA) and the Rules and Regulations of this document. 3.1 No Commercial Operator upon Airport property shall fail to obey any lawful directive of any Police Officer, Operations Staff, Ground Transportation Company Management Employee or Regional Taxi Authority Administrator (taxicabs only). Authority is hereby vested in Ground Transportation Management Employees to enforce these regulations including, by way of example but not by way of limitation, authority to monitor the business activities – including AVI tracking - and the meet and greet of passengers by commercial operators at the Airport, to control vehicular traffic and solicitation at the Airport, to direct motor vehicle movements within commercial loading and unloading areas, and to require the removal of commercial motor vehicles from loading and unloading areas in order to alleviate congestion.

4 AIRPORT ACCESS 4.0 All commercial ground transportation activities, including those operations conducted under proper California Public Utilities Commission and/or Monterey County Regional Taxi Authority, are prohibited on the Airport, unless expressly permitted to operate on the Airport in writing, in advance, and under permit by the General Manager or designee. 4.1 Each Commercial Operator seeking to conduct business activities and to operate motor vehicles upon Airport premises shall register with the Airport Police Department Administrator each Ground Transportation Year and shall possess an airport sticker permit for each vehicle accessing the Airport for the purpose of conducting business at the Airport, or shall be assessed a penalty fee. Taxicab operators, as a combined fee, must purchase an airport sticker permit and AVI medallion. FEES AND PENALTIES FOR GROUND TRANSPORTATION 5.0 Permit Fee: Each Commercial Ground Transportation Vehicle defined in section 1.1 shall pay Monterey Peninsula Airport District a permit fee per vehicle annually to operate at the Airport. A permit involves the issuance of a colorized sticker for all commercial operators designated for the appropriate ground transportation year, and an AVI Medallion issued one-time only for taxicabs (Section 6). Permit fees are established in the rates & charges schedule established by Board resolution. If airport access commences during the annual permit cycle, the Commercial Operator shall pay the pro rated portion of the annual fee for the remainder of the term of the annual permit. The term of the annual permit is from July 1st through and including June 30th. Each Operator shall pay the applicable permit fee in advance, (a) on or before the date it wishes to commence operations (if purchasing a new permit); or (b) on or before July 1st of each year (if renewing an annual permit). 5.1 Permit Process: A registration application must be completed in full and applicable insurances and other requirements set forth in this document including annual permit fees due must be received by the Airport Police Administrator prior to the issuance of an AVI Medallion and Sticker Permit. AVI Medallions and Sticker Permits may be purchased by appointment at the Airport Police Administration Office. Notifications will be issued via mailings, website postings and/or other announcements prior to each Ground Transportation Year. 5.2 Airport Surcharge Fee: Each Commercial Taxicab Operator dropping off and picking up passengers will be assessed an airport per trip surcharge fee, except by waiver listed in section 5.3. Each represented taxicab company will be issued a monthly invoice with the total surcharges incurred by its fleet. The Operator shall remit payment of fees within thirty (30) calendar days to the Airport. Surcharge fees are established in the rates & charges schedule established by Board resolution. 5.3 Waiver of Airport Surcharge Fees: Each Commercial Taxicab Operator dropping off or picking up passengers will not be assessed an airport per trip surcharge fee under the following events: When a passenger returns to the Airport to retrieve lost luggage or a rental car which was unavailable during their initial flight arrival; an RTA senior script program voucher or other unusual circumstances deemed acceptable to the Airport Manager, his designee or the Ground Transportation Management Company. 5.4 Delinquent Fees: Commercial Operators are considered delinquent after the original due date referenced is section 5.2. Airport Surcharge Fees not received by the Airport District prior to 5:00pm,

5 on the day after the due date, the Commercial Operator shall pay a late charge of five percent (5%). At the discretion of the Airport Manager, Commercial Operators with delinquent fees attempting to access the Airport may be expelled without having access to passengers or the terminal, and will not be allowed to conduct any Ground Transportation business. Expulsion will be performed by Airport Operations Staff, Law Enforcement Officers and/or the Ground Transportation Management Manager. The Airport will mail a statement for payment in arrears as a written record of fees owed. 5.5 No Diversion of Passengers: Ground Transportation Operators shall not, through their officers, agents, representatives, or employees, divert or cause to be diverted any prospective customer or item to a location off the Airport, in order to pick up or drop off said customer or item off the Airport and thereby avoid paying the fees and charges that would otherwise be owed to Airport hereunder. For example, and without limiting the foregoing, a Ground Transportation Operator shall not instruct a customer to utilize a Hotel/Motel Courtesy Vehicle to be transported or to transport an item off the Airport in order to then pick up the customer or item at a hotel/motel off the Airport to avoid paying fees and charges hereunder. A Ground Transportation Operator shall not instruct a potential customer to utilize a taxicab, limousine, or other form of public transportation, and offer to reimburse the customer for the cost of said transportation, in order to pick up the customer or item at a location off the Airport. 5.6 Refusal of Fares: Commercial Operators may only refuse a fare as follows: (a) A voucher offered by the Airlines (b) If the passenger(s) luggage exceeds the capacity of the vehicle (c) The vehicle is not equipped with a credit card machine and is the sole method of payment by the passenger (refer to section 11.0(f)) (d) Any other right of refusal as stipulated in the Rules & Regulations set forth by the Public Utilities Commission, or Regional Taxi Authority. 5.7 Penalties: (a) Every person who violates any provision of these rules & regulations is guilty of an infraction and upon conviction thereof shall be punishable by the penalties defined under MPAD Ordinances 911 or 912 and potential additional measures imposed by the California Public Utilities Commission or Monterey County Regional Taxi Authority Regulations. (b) In any action or proceeding to collect fees, penalties and interest due under these rules and regulations, the Airport shall be entitled to recover from the other party all costs, expenses and attorneys fees associated with such collection. (c) Should Commercial Operator(s) fail to timely pay all fees and expenses as required by these Rules and Regulations, such Commercial Operator may be denied access to the Airport until payment in full is made, including any applicable late fees. (d) Jurisdiction and venue for any suit, right or cause of action arising under or in connection with these Rules and Regulations shall be exclusively in the County Court of Monterey, California.

6 AUTOMATED VEHICLE IDENTIFICATION MEDALLION REQUIREMENTS 6.0 The Monterey Peninsula Airport District maintains and operates an Automated Vehicle Identification (AVI) system. Before operating motor vehicles upon Airport premises, except as otherwise hereinafter provided, Commercial Taxicab Operators that will access the Airport shall secure an AVI Medallion for each of their vehicles and follow the medallion fee and display guidelines for passenger operators described in section 7. At the discretion of the Airport Board of Directors, TCP and Passenger Courtesy Vehicle Operators may be required to purchase an AVI Medallion and assessed an airport surcharge. 6.1 Airport sticker permits and AVI Medallions purchased from other airports may not be used. 6.2 Unless authorized by the Airport Manager or designee, airport sticker permits and AVI Medallions shall not be transferred between or among vehicles within the fleet of a Commercial Operator and the use by a Commercial Operator of an airport sticker permit and AVI Medallion issued to a different Commercial Operator is strictly prohibited. 6.3 Medallions will be deactivated in the event of misuse and access to the Airport denied. AVI MEDALLION FEE AND DISPLAY GUIDELINES FOR COMMERCIAL OPERATORS 7.0 All taxicab vehicles providing service at the Monterey Peninsula Airport are required to obtain and display an AVI Medallion with the airport operating permit sticker. All TCP and Courtesy Vehicle Operators pursuant to Ordinance 911 are only required to purchase an annual Airport sticker operating permit at this time. Any Commercial Taxicab Operator that does not display an AVI Medallion and Permit Sticker will immediately be issued a citation assessed as a penalty in an amount as prescribed in Ordinance 911 or 912 and required to leave the Airport premises immediately. 7.1 The following rules apply to all AVI Medallion and Sticker Permit holders: (a) AVI Medallions and Sticker Permits must be affixed as directed so they are plainly readable by Airport District personnel and/or Ground Transportation Management employee at all times. The exact location of AVI Medallions and Sticker Permits will be affixed to the vehicle by Airport or Ground Transportation Management personnel. Use of fixatives other than permanent adhesive is prohibited and shall result in the loss of tampered or improperly affixed AVI Medallion and Sticker Permits. The Airport Manager or his designee, Ground Transportation personnel or Regional Taxi Authority administrator is hereby authorized to check the fixative or use of any permit which may appear suspect. Undisplayed AVI Medallions and Sticker Permits without the appropriate color, expiration date, identification number, and AVI Medallions and Sticker Permits displayed in any other location or with any other fixative will be deemed invalid and the vehicle will be deemed to be un-permitted and charged a Penalty Fee. (b) AVI Medallions and Sticker Permits are not transferable from one vehicle to another except in the case of the destruction or sale of a vehicle and its replacement, proved to the satisfaction of the Airport Manager, his designee or Ground Transportation Management personnel at their sole discretion. (c) If an AVI Medallion and/or Sticker Permit is damaged, destroyed or unreadable by AVI equipment, a new AVI Medallion and/or Sticker Permit will be issued only when the remains of the

7 purchased Medallion/Permit are turned into the Airport Police Department Administrator or Ground Transportation Management personnel. Should AVI Medallions become inoperable for reason of neglect or abuse, it is the responsibility of the commercial operator to purchase a new one. Vehicles not displaying an AVI Medallion and Sticker Permit due to its damage or destruction will be assessed a Penalty Fee. MOTOR VEHICLE OPERATING REQUIREMENTS 8.0 Commercial Operator motor vehicles with an Airport permit shall be operated in compliance with the following requirements: (a) Unattended Vehicles: 1. It shall be prohibited for any Commercial Operator to leave its motor vehicles unattended upon Airport roadways or in the commercial lanes of the Terminal. Notwithstanding the foregoing, a Commercial TCP or Hotel/Motel Courtesy Vehicle Operator, may leave an unattended vehicle in an authorized area (Attachment #1) of Airport property if meeting and greeting a prescheduled passenger in accordance with Sections 9.0, not longer than thirty (30) minutes or otherwise directed by an on- duty Airport Police Officer. 2. Vehicles left without a driver, in contravention of these rules and regulations, in unauthorized areas of the Airport, or in a manner that causes an obstruction of traffic shall be immediately towed from the Airport at Commercial Operator’s expense. 3. Commercial Ground Transportation Curbside Employees shall have authority, in their sole discretion, to require Commercial Operators to move their vehicles in order to maintain efficient traffic movement, to maintain Transportation Security Administration security requirements, and operating requirements set forth in this document. (b) Passenger Drop-Off in Designated Areas outside the Terminal Building: 1. Commercial TCP and Courtesy Operators must deliver departing passengers to the departure curb of the Terminal in the designated parking stalls indicated in Attachment #1 unless directed by Airport or Ground Transportation Management personnel to another specific area. Attended vehicles may be in these designated drop-off areas only for the time required to unload passengers and baggage. 2. Taxicab Operators shall drop off passengers at one of the two (2) available parking stalls located immediately behind the taxi terminal queuing area (see Attachment #1). Drop-off of passengers at other terminal locations is not permitted unless unusual circumstances that require a deviation of procedures are authorized by the Airport or Ground Transportation Management personnel. (c) Passenger Loading in Designated Areas outside the Terminal Building: 1. Commercial TCP and Courtesy Operators must pick up arriving passengers at the baggage claim area of the Terminal or in the designated parking staging area listed in Attachment #1 unless directed by Airport or Ground Transportation Management personnel to another specific area.

8 Attended vehicles may be in these designated pick-up areas only for the time required to load passengers and baggage or otherwise permitted in Section 8.0(d). 2. Taxicab Operators pick up on-demand passengers at one of the three (3) available parking stalls located at the taxi terminal queuing area (see Attachment #1). Taxicab Operators shall pick up pre-arranged passengers as indicated on Attachment #1 and as defined in Section 9.0(b), and are not authorized to leave their vehicle unattended or wait at great lengths, and must comply with Airport Police directives. Passenger pick-ups at other terminal locations are not permitted unless unusual circumstances require a deviation of procedures and are authorized by Airport or Ground Transportation Management personnel. (d) Use of Commercial Vehicle Staging Lot (Except for Taxis): If necessary, all TCP and Courtesy Vehicle Operators who have operating privileges may make use of the 30 minute first come first serve Staging Area (see Attachment #1). Drivers must remain with all parked vehicles, unless a particular driver is the one (1) designated Commercial Operator allowed inside the terminal for purposes of meeting a prearranged pick-up pursuant to these Ground Transportation Rules. (e) Use of Taxi Holding Lot: All Commercial Taxi Operators who have operating privileges with the Airport shall make use of the Taxi Holding Lot (Attachment #2) when arriving at the airport to pick up an on-demand fare, unless otherwise permitted by Airport or Ground Transportation Management personnel, and may park their vehicles within the temporary parking area of the Commercial Taxi Holding Lot. Drivers must remain with all parked vehicles and adhere to the posted rules set forth by the Ground Transportation Management Company. (f) Use of Taxi Terminal Queuing Area: All Commercial Taxicab Operators who have operating privileges with the Airport shall respond from the Taxi Holding Lot to the Taxi Terminal Queuing parking area in front of the terminal (Attachment #1), for queuing and loading of passengers when notified. (g) Taxi Staging Notifications: All Commercial Taxicab Operators will be advised on specific procedures, developed by the Ground Transportation Management Company, when to respond from the Taxi Holding Lot to the Taxi Terminal Queuing Area and will only be allowed access to the Terminal in proper sequence. Taxicabs may leave the Airport premises; however forfeit their place in line if the window sequence has expired. (h) Cruising Prohibited: It shall be prohibited for Commercial Operators to engage in Cruising upon Airport property. (i) Airport Parking Lots: Commercial Operators shall not conduct any business upon or leave commercial vehicles in public parking lot facilities, including employee parking lots. Any commercial vehicle parked in public parking facilities will be towed at the expense of the Commercial Operator. This includes commercial vehicles used as personal vehicles of employees. Exceptions to this rule may be granted at the discretion of the Airport Manager, his designee or Commercial Transportation Management personnel as defined in Section 11.0(g) and 11.0(h). It shall be the responsibility of the owner and/or operator of any such vehicle to request such an exception in advance from the Airport Police or Operations Department, and to furnish the license number of the vehicle which is to be parked in an Airport parking facility to the Airport Police, Operations Department or Ground Transportation Management company if the request is granted.

9 (j) Double Parking Prohibited: Double parking of motor vehicles by Commercial Operators upon Airport roadways is prohibited. (k) Motor Vehicle Markings: Motor vehicles operated upon Airport property by Commercial Operators, whether or not for hire, shall have clearly displayed and permanently affixed on both sides of the vehicle the name of the Operating Company and all applicable California Public Utilities Commission, Federal Highway Administration authority numbers and/or applicable rules outlined by the Regional Taxi Authority Regulations. (l) Vehicle Safety: Commercial Operators shall maintain all motor vehicles operated upon Airport roadways in accordance with vehicle safety requirements of the California Public Utilities Commission and other state, county, city law and/or Regional Taxi Authority Regulations. MEETING AND GREETING PASSENGERS 9.0 Pre-arranged Pick-ups: (a) TCP and Courtesy Vehicle Operators, with prearranged pick-ups are authorized to meet passengers inside the Airport Terminal lobby or baggage claim, or in areas authorized by the Airport Manager or his designee and as outlined in Section 8. Operators shall have a passenger manifest available for immediate review by Ground Transportation Management personnel upon request. This manifest shall contain the date, full name of the passenger, number of affiliated riders, and airline with flight number. Flight numbers and date may be excluded only in cases when the patron explicitly has engaged in a business transaction with Airport Staff, its concessions or other aviation service providers. This manifest shall be carried by the driver of the Commercial vehicle operator. (b) Taxicab Operators, with pre-arranged pick-ups at the terminal are restricted as follows: 1. Flight Arrivals. The operator must produce the passenger’s full name, number of affiliated riders in the same party, and the arriving airline and flight number. 2. Produce the full name of the patron which has explicitly engaged in an active business transaction with Airport Staff, its concessions or other aviation service providers. 3. May not accept Airline Vouchers as a pre-arranged pick-up fare. 9.1 No Commercial Operator of any ground transportation company may porter passenger baggage unless the passenger has, without solicitation from the Commercial Operator, requested such assistance; or unless the Commercial Operator is claiming and delivering delayed baggage under contract. (a) Drop Off: If a passenger requests baggage assistance from the Commercial Operator at the time of drop-off and unloading, the Commercial Operator may assist the passenger with his or her baggage as defined in Section 8.0(a)1. (b) Pick Up: If the passenger requests baggage assistance from the Commercial Operator at the time of pick-up, the Commercial Operator may assist the passenger with the baggage. The operator may take the passenger’s luggage from the baggage claim area to the vehicle, and return for additional baggage without violating curbside parking privileges set in Section 8.0(a)1. 9.2 Self-service luggage carts, if located throughout the Airport for use by the traveling public shall not be gathered or retained by Commercial Operators for resale or for use in the operation of their

10 businesses or for any other purpose. Commercial Operators shall not contract verbally or in writing with any other parties for the purpose of utilizing self-service luggage carts in the operation of their businesses. 9.3 Meeting and Greeting Walk-Up Passengers Commercial Operators or other Company Representatives may not meet Walk-Up, or non- prearranged passengers inside the Airport Terminal. SOLICITATION AND BUSINESS RESTRICTIONS 10.0 It shall be prohibited for any Commercial Operator to conduct any ground transportation business or concession upon the Airport or roadways or other facilities used or operated in conjunction with the Airport or for any person to sell, offer for sale or furnish any ground transportation service or commodity upon the Airport except as specifically authorized herein for Commercial Operators. 10.1 Commercial Operators shall not engage in Solicitation upon Airport premises by initiating or engaging in a conversation regarding ground transportation services with any person on the airport for the purpose of seeking passengers or customers for a commercial passenger vehicle operator; employing, inducing, arranging for or allowing any person to initiate or engage in a conversation regarding ground transportation services with any other person on the airport for the purpose of seeking passengers or customers for a commercial passenger vehicle operator; engaging in any conduct or activity intended to or apparently intended to ask, implore or persuade a passenger or potential passenger to alter his or her previously chosen mode of ground transportation or commercial passenger vehicle operator, delivering literature on the airport discussing or describing ground transportation services to be provided by a commercial passenger vehicle operator to any person on the airport; or offering ground transportation services provided by a commercial passenger vehicle operator to any person while on the airport. “Solicitation” does not include actions by employees of any airline in arranging for transportation for any passenger of such airline. 10.2 Commercial Operators likewise shall not enter into or attempt to make any arrangement with the curbside management company, maintenance employees, airline or other tenant employees, Airport District employees whether or not for compensation whereby such persons undertake or agree to engage in Solicitation for a Commercial Operator. COMMERCIAL OPERATOR CONDUCT UPON THE AIRPORT 11.0 Commercial Operators doing business upon Airport premises as authorized herein shall abide by the following rules of conduct while upon the Airport: (a) Commercial Operator Demeanor: Commercial Operators shall be courteous to the public and to other Commercial Operators and their employees. The Commercial Operator’s employees shall be clean, efficient and neat in appearance. Commercial Operators shall not allow employees on the Airport to use improper language or to act in a loud or boisterous or otherwise improper manner. Commercial Operators shall not engage in open, notorious and public disputes, disagreements or conflicts intending to deteriorate the quality of the ground transportation services of Commercial Operators or their competitors or incompatible with the best interests of the public at the Airport.

11 Obscene communications, threats of violence or physical harm, fighting, gambling, public intoxication and carrying of weapons or illegal substances on Airport premises are expressly prohibited. (b) Deception of the Public: It shall be a violation of these Rules for a Commercial Operator to deceive or attempt to deceive the public through false representations concerning its prices or services or those of any other ground transportation provider. (c) Obedience to Signs: Commercial Operators shall obey all posted signs located upon Airport property. (d) Name Identification Tags: At all times while on Airport Property, Commercial TCP and Courtesy Vehicle Operators, shall wear identification of the driver and company representative name of the Commercial Operator with whom he or she is associated. Name identification tags for Commercial Taxicab Operators are subject to Regional Taxi Authority Regulations. (e) Sleeping: Commercial Operators are prohibited from sleeping inside the Airport Terminal Building or inside their vehicles at the Taxi Terminal Queuing Area or TCP and Courtesy Vehicle staging areas. Drivers observed sleeping are subject to return to the Taxi Holding Lot or dismissed from Airport property. (f) Credit Card Machines: Commercial Vehicles equipped with credit card processing machines are prohibited to decline a fare by means of accepting cash as preference. Violators will be immediately expelled and subject to suspension and permit revocation. (g) Food and Drink: 1. Commercial Taxicab Operators, with a valid permit, are authorized to purchase food and drink inside the Airport Terminal provided the following conditions are met: a) The driver informs the Ground Transportation Management Company in advance and within an authorized parking area as directed by the Ground Transportation Management Company. b) Does not exceed a specific time period determined by the Ground Transportation Management Company. c) The driver purchases their Food and Drink to go and displays a receipt if requested by the Ground Transportation Management Company. d) Not engage in casual conversation with other drivers within the authorized waiting areas as defined in 11.0(j). 2. No Commercial Operator shall provide food or drinks to its customers at any location upon Airport Property other than in motor vehicles operated by Commercial Operators. 3. All personal food and beverage or other items brought into the Airport Terminal by a Commercial Operator Representative must remain in the possession of the person at all times while in the Terminal. Any unattended items will be disposed of by Airport personnel. (h) Terminal Restrooms: Commercial Operators not located at the Terminal Queuing Area, are authorized to utilize the restroom facilities at the terminal provided the following conditions are met:

12 1) The driver informs the Ground Transportation Management Company in advance and within an authorized parking area as directed by the Ground Transportation Management Company. 2) Not engage in casual conversation with other drivers within the authorized waiting areas as defined in 11.0(j). 3) Not perform any other personal or business functions in contradiction of these rules and regulations. (i) Gratuities: Commercial Operators and their representatives while upon Airport property shall not solicit gratuities or tips, directly or indirectly, from their customers. (j) Authorized Waiting Area: Commercial Taxicab Operators parked at the Taxi Terminal Queuing Area are authorized to wait along the curb immediately in front of the queuing and within the terminal center lobby areas. Waiting is unauthorized in any other areas unless specifically authorized by the Ground Transportation Management Company or Airport Staff for business related activity. SUSPENSION AND REVOCATION 12.0 All Commercial Operators must comply with the lawful directives of airport staff and with these rules and regulations. The Airport Manager or his designee shall have the power to suspend the operating privilege of any Commercial Operator for non-compliance with any lawful directive; a violation of these Ground Transportation Rules and Regulations; behavior that disrupts the effective operation of the Airport Terminal; or any behavior that the Airport Manager or designee determines creates a danger to the Airport personnel, Ground Transportation Management personnel or the traveling public. The Airport Manager or designee shall have the power to revoke the operating privileges of any Commercial Operator or its driver, employee or Company Representative for repeated non-compliance with these Ground Transportation Rules and Regulations or where the Commercial Operator or its representative is deemed a danger to the health, safety, and welfare of any Airport user, the public or Airport employee. 12.1 Suspension: (a) Any failure to comply with the lawful directive of Airport staff or Ground Transportation Management personnel or any violation of these ground transportation regulations by a driver, employee or Company Representative shall result in the issuance of a citation to the Commercial Operator. (b) A Commercial Operator will be immediately suspended if the Airport Manager, or his designee in consultation with Ground Transportation Management determines that the Commercial Operator’s behavior was willful and/or deliberate and a disruption to Airport Staff or the traveling public. (c) If the Commercial Operator whose operating privileges are or may become suspended demonstrates that it is making a good faith effort to remedy its failure to satisfy the requirements, the Airport Manager or his designee may, in his or her discretion, remove or reduce the suspension. Any decision of the Airport Manager concerning suspension of Airport privileges pursuant to this Section of these Rules shall be considered final agency action.

13 12.2 Revocation: (a) The operating privileges of a Commercial Operator receiving three (3) infractions during a Ground Transportation Year shall be revoked for a period of one (1) calendar year. (b) A Commercial Operator whose privileges have been revoked may apply for renewed privileges after a twelve (12) month period has elapsed following the date of revocation, during which time, said revocation was adhered to. The General Manager, or his designee, in his discretion, may allow an earlier re-application following revocation where justified by equitable considerations. (c) A Commercial Operator, driver, employee or Company Representative’s failure to comply with the terms of revocation will result in an added suspension and/or revocation for an additional period of time, which time will be added to the current term of revocation. (d) Notwithstanding the notice provisions hereof, the Airport Manager or his designee may revoke without notice the operating privileges of any person or entity if, that person or entity is deemed to endanger the health, safety, and welfare of any Airport user, the public, or employees. (e) Any Commercial Operator or Company Representative whose operating privileges are or may become revoked for other than a deliberate or willful violation of such requirements may request a meeting with the Airport Manager, his designee and Ground Transportation Management so as to demonstrate to the Airport Manager or his designee and Ground Transportation Management, at any time prior to such revocation or after such revocation has been imposed, that such operator or person has remedied or is making a good faith attempt to remedy its failure to satisfy the requirements of these ground transportation regulations granted to such Commercial Operator. (f) If the Commercial Operator or Company Representative whose operating privileges are or may become revoked demonstrates that it is making a good faith effort to remedy its failure to satisfy the requirements, the Airport Manager or his designee may, in his or her discretion, reverse the revocation if such revocation has been imposed, or abandon the procedure if such revocation has not yet been imposed. (g) Hearing Procedure: Any Commercial Operator whose operating privileges have been revoked shall have the right to a hearing provided by the Airport Manager, his designee, Airport Board or in case of violations related to Regional Taxi Authority ordinances, rules or regulations, the Regional Taxi Authority Board (taxicabs); except where the basis of the violation has been proved in a court of law or before another local, state or federal regulatory or governmental agency. Such a hearing must be requested within ten (10) days of receipt of the notice of revocation. The Airport Manager or designee shall have the authority to waive the time requirements set forth herein upon good cause shown. The Airport Manager, his designee, Airport Board or Regional Taxi Authority Board (taxicabs) decision following said hearing shall be deemed final agency action. All revocation periods will be held in abeyance pending any hearing or appeal. INSURANCE 13.0 Commercial Operators, except Taxicab Operators, shall submit certificates of insurance in a form acceptable to the Airport Manager and/or designee with coverage in amounts required by the terms of these Rules and Regulations.

14 13.1 Licensed Regional Taxi Authority Taxicab Operators shall maintain appropriate insurance requirements established within the Regional Taxi Authority Regulations. 13.2 Commercial General Liability Insurance: A Commercial Operator, except Taxicab Operators, shall maintain a comprehensive general liability insurance policy which will cover against liability for injury to persons and/or property, and death of any person or persons occurring in or about the airport. (a) Commercial General Liability: Commercial General Liability Bodily Injury/Property Damage Combined Single Limit: $1,000,000. (b) Comprehensive Motor Vehicle Liability Insurance; Bodily Injury/Property Damage Combined Single Limit: $1,000,000. 13.3 Motor Vehicle Insurance: A Commercial Operator shall maintain a motor vehicle insurance policy, provided by an insurance company authorized to do business in the state of California in such minimum amounts as required by the California Public Utilities Commission or State Law. 13.4 Additional Insured: Monterey Peninsula Airport District shall be endorsed on comprehensive general liability and motor vehicle liability policies as an additional insured. The Commercial Operator, except Taxicab Operators, shall furnish certificates to the District prior to commencing operations evidencing that the insurance is in full force and effect during the term of the operating privilege and that Monterey Peninsula Airport District be notified, in writing, by the insurers at least ten (10) days prior to any cancellation of the policy. 13.5 Indemnification: Commercial Operators shall indemnify, defend, and save Monterey Peninsula Airport District and their respective agents, officers, and representatives and employees harmless from and against any and all judgments, penalties, liability or loss, including costs and reasonable attorney’s fees resulting from claims or court actions, whether civil, criminal or in equity, arising directly or indirectly out of acts of the Commercial Operator, his agents, employees or servants, or through any injury or casualty occurring on the Airport as a result of said loss. 13.6 Workers Compensation: The Commercial Operator shall maintain the statutorily required workers’ compensation insurance coverage on all employees unless otherwise indicated in the Monterey County Regional Taxi Authority Regulations.

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 2 of 22 PURPOSE The purpose of these rules and regulations is to provide for the safe and efficient operation of ground transportation activities and services at the Wichita Mid-Continent Airport (Airport), to ensure a high quality of public service, to establish permit application and permitting procedures, and to establish standard and consistent regulatory policies among all ground transportation providers. In addition to general rules that are applicable to all ground transportation providers, specific rules applying to types of commercial ground transportation providers are addressed in these rules and regulations. Additionally, the Code of the City of Wichita sets forth and establishes regulations under Chapters 3.84, 3.85, and 3.88 within the City of Wichita. The Wichita Mid-Continent Airport is located within the Wichita city limits, and as such, commercial ground transportation providers and operators are subject to compliance with applicable City Code, and as may be duly amended, while operating on Airport property. APPLICABILITY These rules and regulations apply to all ground transportation providers and operators that provide courtesy/complimentary service, “for hire” prearranged charter bus, van or limousine, or “on-demand” taxicab or shuttle ground transportation services from and upon Airport property. These rules govern all public areas of the Airport, including, without limitation, its terminal buildings, roadways, parking facilities, and all other surface areas on Airport property. Commercial ground transportation providers are not required to hold a permit with the Airport Authority solely for passenger drop-off. LAWFUL AUTHORITY The Wichita Airport Authority (WAA), pursuant to the provisions of the Code of the City of Wichita, shall implement and enforce these rules and regulations. These rules and regulations shall be in addition to the licensing, maintenance, and inspection requirements set forth in Chapters 3.84, 3.85, 3.88, and Airport rules and regulations set forth in Chapter 9.35 of the City Code, and as may be duly amended. Pursuant to the Code of the City of Wichita, the Director of Airports and his/her designee has the express authority to enforce all provisions of the City Code relating to commercial ground transportation providers while on Airport property.

James Jabara Airport, and any other airport owned by and under the control and jurisdiction of the Wichita Airport Authority. Airport Authority. The Wichita Airport Authority (WAA) as established by Section 2.12.1040 of the Code of the City of Wichita, Kansas. Airport Motor Vehicle Parking Facility. Any surface or enclosed facility used or intended to be used for nonexclusive (public) use of revenue producing or nonrevenue producing parking of private motor vehicles on Airport property. Such term does not include leased premises parking facilities under a tenant lease agreement. Airport Police and Fire Officer. A person holding a State of Kansas law enforcement commission and a member of the Airport Police and Fire Division of the City of Wichita Airport Department established pursuant to Section 2.12.1051 of the Code of the City of Wichita, Kansas. Airport Property. Any property, facilities, and improvements owned, leased, and/or under the control and jurisdiction of the Wichita Airport Authority and roads and streets contained thereon. Airport Tenant. Any person holding a duly executed and current lease or license agreement with the Wichita Airport Authority for the lease of property and/or the conduct of certain specified commercial activities. Authorized. Acting under or pursuant to a written contract, permit, authorization or other evidence of right issued by the Director of Airports. Commercial Activity. Is defined as: 1) the exchange, trading, buying, hiring or selling of commodities, goods, services or property of any kind on Airport property; or 2) engaging in any conduct on Airport property for revenue producing purposes, whether or not currency, monetary exchange or other forms of monetary instruments ultimately are exchanged, obtained, or transferred on Airport property; or 3) the offering or exchange of any service on Airport property as a part of, or condition to, other revenue producing activities or services on or off Airport property; or 4) intended for the purpose of securing revenue, earnings, income, and/or compensation (including exchange for service), and/or profit, whether or not such objectives are accomplished. Commercial Ground Transportation Designated Staging, Queuing, and Loading Areas. Located on the roadways adjacent to the commercial passenger terminal to be used for passenger pick-up by commercial ground transportation operators as depicted in APPENDIX B. Commercial Ground Transportation Hang-Tag. A “hang-tag”, issued by the WAA to a permittee for the assignment and use of a specifically identified operator, and to be displayed as directed by these regulations, in each ground transportation vehicle permitted to operate on Airport premises.

A written authorization issued by the WAA granting the nonexclusive privilege of operating motor vehicles upon Airport premises for the sole purpose of providing commercial ground transportation services in the transportation service category or categories as set forth in these regulations and as authorized under the permit issued. Commercial Ground Transportation Permittee or “Permittee”. The commercial ground transportation permittee is the party (person, company or legal entity), who has sought through application, received, and maintains from the WAA a permit to provide commercial ground transportation services in the transportation category or categories as set forth in these regulations and as authorized under the permit issued. Commercial Passenger Terminal or Airline Passenger Terminal. Any passenger terminal facility or facilities operated for the purpose of boarding and de-boarding of commercial air travelers, including tenant, concession, security, and other support facilities including all ramps, roadways, vehicular, and pedestrian circulation areas and parking facilities associated therewith. Common Use Area. Any area, whether leased or nonleased, used in common with, concurrent or in conjunction with, and by multiple parties. Such term shall include “nonexclusive area”. Courtesy Vehicle. Any vehicle permitted to transport its customers on Airport property as a “courtesy” service only, not for hire, and not a commercial service provided for direct compensation or hire. Courtesy vehicle service is further defined as a transportation service offered as a “courtesy” or “complimentary” service only to patrons incidental to and supporting another commercial service. This definition excludes, and therefore permits, the acceptance of gratuities by drivers. This service offering is considered to be service as a part of, a condition to, ancillary to, or in support of other revenue producing activities or services on or off Airport property. Curbside Area. For the purposes of these rules and regulations, shall mean the street curb of the public traffic lane(s) of the commercial passenger terminal area immediately outside and adjacent to the building used for the purpose of passenger drop-off and pick-up only. Director. The Director of Airports of the City of Wichita or his or her duly authorized and designated representative(s). Exclusive Ride. The exclusive use of a taxicab by one or more passengers at a time having common origins and destinations. Fares or Customers. Any person who arrives at or departs from the commercial passenger terminal by means of any category of commercial ground transportation. Group Ride. The use of a taxicab by a group of passengers who generally enter the taxicab at the same location and disembark at the same destination, and pay a single fare for the trip. Law Enforcement Officer (LEO). Any City of Wichita employee holding a State of Kansas law enforcement commission or other officer vested with the power of arrest under federal or state authority. Limousine. A sedan, “stretch” or “luxury” vehicle, van or other motor vehicle that has a seating capacity of not more than fifteen passengers including the driver, and that is used for the transportation of persons on a prearranged basis. Not a “walk-up” or “on-demand” service. (See also definition of Prearranged Services.)

The actions or conduct of a commercial ground transportation provider or operator parking or lingering in any area of Airport property, except for the specific purpose or objective of obtaining an “on- demand” fare, meeting a prearranged customer, or loading or unloading passengers and/or baggage. Motor Vehicle. A device in, upon or by which a person or property may be propelled, moved, or drawn upon land, except a device moved by human or animal power and except aircraft or devices moved exclusively upon stationary rails or tracks. The term “vehicle” shall include taxicabs, cars, buses, vans, shuttles, trucks, buses, limousines, and courtesy vehicles of any type or kind. Nonregistered Operators. Not registered with the WAA, not holding a commercial ground transportation operating permit issued by the WAA, and not authorized or permitted to engage in commercial ground transportation services on Airport property except by express prior approval of the Director and operating in compliance with the provisions of these rules and regulations. On-Demand Services. On-demand type commercial operations shall be defined as a customer fare “walk-up” who requests ground transportation services without prior arrangement or reservation for such services. Not a prearranged service. Operator. Any person who is in actual physical control of a motor vehicle. Driver. Other Authorized Officer. Any noncommissioned officer and authorized representative of the Director of Airports, including Airport Services Officers and Airport Operations Officers of the City of Wichita Airport Department. Owner. A person, company or other legal entity in whose name the legal title of a motor vehicle is held or vested. If any motor vehicle is the subject of a conditional sale or lease, with the right of purchase upon performance of the conditions stated in the agreement, and with the immediate right of possession vested in the conditional vendee or lessee or anyone in possession of a motor vehicle on the Airport, or in the event a mortgagor of a motor vehicle is entitled to the possession, then the conditional vendee, lessee or mortgagor shall be deemed the owner for the purpose of this chapter. Park. To put, leave or let a motor vehicle stand or stop in any location whether the operator thereof leaves or remains in such vehicle, when such standing or stopping is not required by traffic control or conditions beyond the control of the operator. Person. Any individual, firm, partnership, corporation, company, association or joint stock association, and includes any trustee, receiver, assignee or similar representative thereof. Permittee. The holder of a commercial ground transportation operating permit. Prearranged Services. A prearranged commercial operation shall be defined as ground transportation services provided through prior communication, arrangement or reservation for such services. Not a “walk-up” on-demand service. “Prior” is defined as communications that shall have been initiated by a person contacting a service provider in person, by telephone or other written or electronic communications prior to the customer(s) arrival at the Airport. Subject to prior approval of the WAA and the specific conditions of an operating permit, a prearranged service may also be defined as an arrangement or reservation for services from/at a leased ground transportation transaction counter within the airline passenger terminal.

Any real estate, building or facility on Airport property, including grounds, roadways, streets and sidewalks which are not designated as an AOA, SIDA, Secured Area, Sterile Area or Restricted Area, not leased premises, or not specifically signed as a Restricted Area. Public Vehicle Lanes. The public traffic lanes of the commercial passenger terminal area immediately outside and adjacent to the building used for public pick-up and drop-off of arriving/departing passengers by private motor vehicle, and not permitted for use for commercial ground transportation customer pick-up. Restricted Area. Any area of an airport that is fenced, locked or posted by sign to prohibit or limit entry or access to only specific authorized persons. Revenue Producing or Paid Parking. Those designated motor vehicle parking areas available to the general public, employees, and invitees in which the Airport Authority or its contractor assesses a published parking fee for such parking services. Shared Ride. The nonexclusive use of a motor vehicle by two or more passengers, generally traveling between different points of origin and/or destination, but in the same general direction, and each paying an individual fare for the trip. Short Fare. A “short fare” is defined as a circumstance, in violation of these rules and regulations, in which an owner or operator refuses service, removes, directs the removal of or causes to be removed a customer or customers from a commercial ground transportation vehicle at any location commencing at the point of departure. Shuttle. A van or other motor vehicle that has a seating capacity of not more than fifteen passengers including the driver, and that is used for the transportation of persons on a specified and published route and schedule. This transportation service may allow either “prearranged” and/or “on-demand” services. (See also definition of Prearranged Services and On-Demand Services.) Solicit or Solicitation. To orally or visually, directly or indirectly, actively or passively, openly or subtly, ask or endeavor to obtain by asking, requesting, gesturing, exhibiting, imploring, pleading for or trying to obtain. Standard Operating Procedure or Airport Standard Operating Procedure. A written order, procedure or directive issued by the Director of Airports. Requires specific operational procedures or prohibits specific operations or types of operations, onto or from Airport property; or establishes designated and restricted uses of various areas of Airport property. Taxicab. Any motor vehicle which is furnished for hire on a call or demand basis to transport persons, packages or messages where the route traveled and trip destination are controlled by the passenger, and a charge or fare is based upon time and mileage recorded and indicated on a taximeter except that the following shall not be considered to be taxicabs: 1) Motor buses operated by Wichita Transit of the City of Wichita; 2) Motor buses and motor vehicles engaged exclusively in the transportation of students to and from school, commonly known as school buses; 3) Vehicles operated by a person or company used to transport persons who are the employees, patrons, guests, residents or customers of the person or company, where the provision of such transportation is incidental to the business of such person or company and no fee is charged;

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 8 of 22 4) Group riding or an arrangement between individuals whereby they pool their private transportation resources either by using the personal automobile of one member of the group with the others contributing to the costs of operating the same, or by rotating the use of their personal automobiles with joint contributions to the cost by the other members of the group or when any employer provides transportation for its employees and for no other individuals; 5) Vehicles which are licensed as shuttles, limousines, or courtesy vehicles by the City of Wichita and/or the Wichita Airport Authority. SECTION 2 APPLICATION PROCESS 2.1 Application for Permit. Applicants for a Commercial Ground Transportation Operating Permit(s) shall obtain, fill out, and submit to the WAA an application for a Commercial Ground Transportation Operating Permit(s) with associated documentation. (See APPENDIX A-1, A-2.) 2.1.1 Transportation Service Categories. A single operating permit may be issued for one or more of the following transportation service categories: 2.1.1.1 Taxi 2.1.1.2 Limousine 2.1.1.3 Shuttle 2.1.1.4 Courtesy Vehicle 2.2 Parties seeking to provide ground transportation services on Airport property may obtain the appropriate application form, complete and submit such form for a single operating permit for each category of commercial ground transportation service sought. (See APPENDIX A-1, A-2.) Multiple operators (drivers) and vehicles for the same category of service may be included under a single application and permit. (See APPENDIX A-1, A-2.) 2.3 Permit and Hang-Tag in Possession. Each operator is required to carry a copy of the operating permit in the vehicle, and shall be presented to an Airport Police and Fire Officer or other authorized officer of the WAA on demand at any time while on Airport property. The ground transportation permittee or operator is responsible for duplicating copies of said permit to be carried in vehicles. Each operator is required to display in the vehicle a correctly issued hang-tag at any time while picking up passengers on Airport property. 2.4 Renewal. Commercial ground transportation operating permits and hang-tags are valid for twelve (12) calendar months from the anniversary date of permit issuance, and shall expire at 11:59 p.m. on the anniversary date of issuance. 2.5 The procedures contained in this Section shall be followed whether seeking an initial or an annual renewal of the commercial ground transportation operating permit. 2.6 Application and Renewal Requirements and Documentation. 2.6.1 Completed and signed application form. (See APPENDIX A-1, A-2.) 2.6.2 Payment of fees.

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 9 of 22 2.6.3 Proof of current and valid motor vehicle insurance. 2.6.4 Proof of City of Wichita licensing (taxicabs only). 2.6.5 Proof of current and valid Kansas driver’s license (with applicable endorsements if appropriate). 2.6.6 Proof of current City of Wichita vehicle inspection (taxicabs only). 2.7 An applicant for commercial ground transportation permit (taxi, limousine, and shuttle) may, upon WAA acceptance of proper application, documentation, payment and insurance, be entitled to one (1) commercial ground transportation hang-tag for each operator (driver) applied for and listed on the Commercial Ground Transportation Operating Permit. Similarly, an applicant for commercial ground transportation permit (courtesy) may, upon WAA acceptance of proper application, documentation, payment and insurance, be entitled to one (1) commercial ground transportation hang-tag for each vehicle applied for and listed on the Commercial Ground Transportation Operating Permit. (See APPENDIX A-1, A-2.) 2.8 Nontransferable. Hang-tags issued to permittees shall be assigned to a specific individual operator or vehicle, and shall not be transferred, shared or loaned to or among other operators or vehicles. 2.9 Prior to issuance of an operating permit and hang-tag(s), payment of fees as set forth under this Section shall be made. 2.10 Place of Application. Application for Commercial Ground Transportation Operating Permits may be made at the Airport Administration Building, 2173 Air Cargo Road, between the hours of 8:30 a.m. and 4:30 p.m. Monday through Friday, excepting government holidays. Call-ahead appointment is recommended; phone number (316) 946-4700. 2.11 Denial of Application. A Commercial Ground Transportation Operating Permit may not be issued to any applicant who: 2.11.1 Is known to have made a false statement on the application for permit; or 2.11.2 Does not hold a valid taxicab company license, vehicle license or driver license issued by the City of Wichita pursuant to Chapter 3.84 of the Code of the City of Wichita; 2.11.3 Fails to comply with the insurance requirements as required by these rules and regulations; or 2.11.4 Fails to make payment as required by these rules and regulations; or 2.11.5 Has previously had a Commercial Ground Transportation Operating Permit permanently revoked under these rules and regulations, or Chapters 3.84, 3.85, 3.88 or 9.35 of the Code of the City of Wichita. 2.12 Fees (New and Renewal). New/initial permit and hang-tag fees are waived for calendar years 2013 and 2014. 2.13 Lost, Stolen or Damaged Hang-Tag Fees. Lost, stolen or damaged hang-tags may be purchased for an additional $10.00. Hang-tag replacement fees are not waived.

SECTION 3 GENERAL OPERATING RULES AND REGULATONS 3.1 Operating Privileges and Right to Deny Commercial Service. The WAA reserves the right to determine the public need, necessity or demand for commercial ground transportation services on Airport property and whether staging/queuing/loading space is or can be made available for such new, renewal or expanded service. The WAA further reserves the right to impose and enforce reasonable operating limitations, including but not limited to operating location and maximum dwell times. Such restrictions or limitations, if any, shall be incorporated into and made a condition of the operating permit. 3.2 Commercial Ground Transportation Operating Permit. No person or party may operate a commercial ground transportation motor vehicle engaged in passenger pick-up upon Airport property without a valid written operating permit issued by the WAA. Permits must be present and available for inspection in commercial ground transportation vehicles at all times while on Airport property. (Permits are not required for passenger drop-off.) Class B Penalty 3.2.1 Permit Expiration. Permits shall expire annually at 11:59 p.m. on the permit issuance anniversary date; or upon the expiration or termination of the commercial ground transportation permittee’s vehicle insurance policy; or upon the expiration, suspension or revocation of permittee’s City of Wichita issued license. 3.3 Commercial Ground Transportation Hang-Tags. No person or party may operate a commercial ground transportation motor vehicle engaged in passenger pick-up upon Airport property without a valid hang-tag issued by the WAA. (Hang-tags are not required for passenger drop-off.) Class B Penalty 3.3.1 Hang-Tag Expiration. Hang-tags shall expire annually commensurate with and corresponding to the conditions specified in Section 3.2.1 Permit Expiration above. 3.3.2 Hang-tags shall be visually displayed and easily identifiable in the vehicle (without demand by officers) at all times while engaged in passenger pick-up on Airport property. Hang- tags shall be used for visual identification of authorized operators. Operators not properly displaying valid and uniquely issued hang-tags in vehicles shall be considered unauthorized to provide commercial ground transportation services on Airport property. Acceptable locations for hang-tags are considered to be on the windshield-mounted rear-view mirror, or other prominent location in the vehicle as authorized by the Airport Police and Fire Division so as to be easily identified through the front windshield. Class C Penalty 3.3.3 Hang-tags are issued to the holder of a commercial ground transportation operating permit (permittee). Each hang-tag issued to a permittee shall be assigned to a specific vehicle operator or vehicle (See APPENDIX A-1, A-2). Class C Penalty

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 11 of 22 3.3.4 Hang-tags may be confiscated for noncompliance with these rules and regulations by Airport Police and Fire Officers, or other authorized officers. Confiscation of a hang-tag suspends commercial operating privileges for that specific operator on Airport property. 3.3.5 Hang-tags are nontransferable and no person shall transfer, loan, sell, or otherwise permit the use of the hang-tag by other than the operator or vehicle in which the hang-tag was issued. Class C Penalty 3.3.6 Permittee shall notify the WAA within seventy-two (72) hours when an operator, who has been issued a hang-tag under the permittee’s operating permit authority, is permanently or indefinitely dismissed, discharged, released, or otherwise separated from his or her contract or employment as a commercial ground transportation operator. Similarly, permittee shall notify the WAA within seventy-two (72) hours when a vehicle, that has been issued a hang-tag under the permittee’s operating permit authority, is removed from the permittee’s fleet. In such cases, hang- tags shall be returned to the WAA upon request within ten (10) business days. Class C Penalty 3.3.7 In the event hang-tags are lost or stolen, the permittee shall give prompt notice of such occurrence to the WAA. A replacement hang-tag shall not be reissued until such notice is received by the WAA, and the fees have been paid for the issuance of a replacement hang-tag. Class C Penalty 3.3.8 All permittees shall pay to the WAA the established fee for the issuance of original, renewal or replacement hang-tags. Class B Penalty 3.4 Motor Vehicle Insurance. Permittees operating on Airport property shall have valid motor vehicle insurance in the amount required for the vehicle and activity as required in Chapters 3.84, 3.85 or 3.88 of the Code of the City of Wichita. Such insurance must be maintained throughout the period of time the permit is authorized. Copies of valid insurance certificates must be provided to the WAA prior to issuance of a permit. Further, a copy of current insurance and registration is to be in the vehicle at all times. (Courtesy vehicle providers shall carry no less than the minimum required by law.) Class B Penalty 3.5 City of Wichita Licensing. No person shall be eligible to apply for a new/initial or renewal operating permit, nor shall engage in commercial ground transportation activity on Airport property that does not hold current and valid company, vehicle, and driver’s licenses issued by the City of Wichita and in accordance with the Code of the City of Wichita. (Limousine, Shuttle, and Courtesy vehicle providers are exempt from this requirement.) Class B Penalty 3.6 Driver’s License. All operators shall have on his or her person at all times while operating on Airport property a current and valid driver’s license issued by the state of Kansas with all appropriate endorsements for the operation and type of vehicle being operated. Additionally, Courtesy vehicle operators shall carry their company issued identification badge, which displays the company’s name, operator’s name, and company issued identification number, as listed on the Commercial Ground Transportation Operating Permit (See APPENDIX A-2). Class B Penalty

Commercial ground transportation permittees and operators will immediately respond to and comply with the lawful directions and instructions of commissioned officers of the Airport Police and Fire Division, Wichita Police Department, and other WAA authorized officers. Class B Penalty 3.8 Loitering. Upon entry onto Airport property without a passenger(s), or after discharging a passenger(s) at the commercial passenger terminal, each commercial ground transportation vehicle shall proceed at once by the most direct route to the commercial vehicle queuing/loading area or immediately depart the commercial passenger terminal area. No vehicle operator or vehicle may park, loiter, delay or stop on the commercial passenger terminal public curbside unless actively unloading passengers and their property. Class B Penalty 3.9 Temporary Sign Display. Commercial ground transportation operators may hold a professional looking sign with the name of the ground transportation service, the customer’s name, and/or the customer’s airline and flight number in public areas of the commercial passenger terminal for prearranged customer pick-ups only. All such operators shall remain clear of pedestrian traffic and not constitute impedance to the orderly flow of customers through the building. No loitering on the curbside or within other terminal areas shall be permitted unless directly engaged in meeting a prearranged customer and only for the minimum necessary time required to do so. Class B Penalty 3.10 Loading/Unloading Passengers. Commercial ground transportation operators may unload passengers at the airline passenger terminal public traffic lane(s), ticketing/departures curbside or other location specifically designated and marked for such purposes. Meeting fares and passenger pick-up, either prearranged or not, is prohibited from the airline passenger terminal public traffic lane(s). Loading of passengers and their baggage shall be performed only at the designated commercial vehicle queuing/loading areas as indicated in APPENDIX B. (No parking/no unattended vehicles/active unloading only regulations apply to the terminal public traffic lanes/curb and are enforceable under Section 9.35 of the Code of the City of Wichita.) Class B Penalty 3.11 Fare Refusal. Fare refusals are prohibited. No commercial ground transportation operator conducting commercial ground transportation services at or upon Airport property shall refuse to transport any person upon such person’s request for ground transportation services unless: 3.11.1 The potential/proposed customer is acting in an unlawful, disorderly, threatening or endangering manner; or 3.11.2 If the operator demonstrates proof to the satisfaction of the WAA that there was a vehicle or equipment failure that reasonably precluded the operator from accepting or continuing service; or 3.11.3 If the operator demonstrates proof to the satisfaction of the WAA that there was a previous business commitment of the operator that reasonably precluded the operator from accepting the customer’s request for services.

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 13 of 22 Unless a customer is acting in an unlawful, disorderly, threatening or endangering manner, or if a customer requests/demands a discontinuation of services and requests/demands to exit the vehicle, or in the case of vehicle or equipment failure, it shall be prohibited for an operator to demand or cause the removal of a customer from a vehicle at any point in transit commencing at the point of departure and the intended drop-off destination. Class A Penalty 3.12 Short Fare. “Short fares” are prohibited from/upon Airport property. Subject only to the conditions allowed in Section 3.12 Fare Refusal above, it shall be prohibited for an operator to demand or cause the removal of a customer from a vehicle at any point in transit commencing at the point of departure and the intended drop-off destination. Class A Penalty 3.13 Parking Zones. Commercial ground transportation operators are required to comply with the designated parking zones in the commercial vehicle staging/queuing/loading area assigned to their class of vehicle as shown in APPENDIX B. Class B Penalty 3.14 Customer Information Notices. Commercial ground transportation operators shall continuously display, while conducting business on Airport property, a notice to customers acceptable to the WAA in the passenger seating area(s). The purpose of such customer notice(s) is to advise customers of the contact information and means by which they may communicate praise, complaints, or problems with the level or quality of ground transportation services they have received to, from or upon the Airport. Such customer notice(s) may either be provided by the Airport Authority, or a permittee may present a proposed notice for WAA review and approval. Notices shall not be altered or changed without the prior review and consent of the WAA. Customer notice(s) shall be clearly and conspicuously displayed in the passenger compartment of the vehicle and shall not be blocked or shielded from customer view at any time while operating on Airport property. (Courtesy vehicle providers are exempt from this requirement.) Class B Penalty 3.15 Unauthorized Access and Use. Under no circumstances shall a staging, queuing or pick-up slot be used by a nonpermitted party and/or vehicle, or an operator whose hang-tag and operating privileges have been temporarily or permanently suspended or revoked. Under no circumstances shall any person or party, other than an authorized representative of the WAA, loiter within a staging, queuing or pick-up area. Class A Penalty SECTION 4 CODES OF CONDUCT 4.1 Commercial ground transportation operators shall, at all times while on Airport property, conduct themselves in a professional, respectful, and courteous manner in dealing with the public, customer(s), other ground transportation operators, Airport tenants, and WAA representatives. Class C Penalty 4.2 No operator shall use profane, abusive, derogatory or obscene language while operating a commercial ground transportation vehicle, be discourteous to a passenger or fail to accede to a passenger's reasonable requests or engage in disorderly conduct as defined by the Code of the City of Wichita. Class A Penalty

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 14 of 22 4.3 No person, unless otherwise duly authorized by federal, state or local law to carry a weapon (such as law enforcement officers on duty or authorized and trained noncommissioned Airport Authority employees and authorized and permitted contractors), shall carry, transport or conceal any firearm or other weapon on Airport property. The provisions of this Section shall not prohibit the carrying of an unloaded firearm, to be transported on a commercial or general aviation aircraft, so long as the weapon is carried in and remains in a locked container. Class A Penalty 4.4 Ground transportation operators shall maintain a clean, sanitary and well-groomed appearance and shall be appropriately attired at all times while engaged in commercial ground transportation services on Airport property. Clothing articles shall be clean and in good repair without holes, rips or tears. The following clothing articles are prohibited while engaged in commercial ground transportation services when worn as outer garments:  Undergarments  T-shirts that have been cut or altered  Tank-tops  Swimwear  Jogging suits  Body suits  Body shirts  Cut-off pants  Sandals, “flip-flops” or other open-toed footwear  Clogs  Offensive and distasteful words or symbols on clothing articles Class C Penalty 4.5 No ground transportation operator shall engage in solicitation or cause the solicitation of passenger fares either directly, indirectly or through a second party. Class B Penalty 4.6 Persons in possession of and carriage of any animal or pet in vehicles is prohibited while engaged in commercial ground transportation services unless such possession and carriage complies with the requirements of Section 9.35.390 of the Code of the City of Wichita. Class C Penalty 4.7 Any person operating a commercial vehicle on Airport property which is involved in an accident resulting in injury to any person or damage to any property shall: 4.7.1 Immediately stop such vehicle or equipment at the scene of such accident or as close thereto as possible; 4.7.2 Notify the Airport Police and Fire Division; 4.7.3 Return to and/or remain at the scene of the accident until Airport Police and Fire has arrived at the scene. To the greatest extent possible and practical, the accident vehicle(s) shall be stopped and parked so as to minimize any obstructions to aircraft and other vehicles;

Class A Penalty 4.8 Ground transportation operators are prohibited from performing maintenance or repair on vehicles anywhere on Airport property. This prohibition excludes the changing of a flat tire. Class C Penalty 4.9 Ground transportation operators are prohibited from driving, stopping or parking, or causing or permitting to be driven, stopped or parked any motor vehicle contrary to WAA sign or marking. Ground transportation operators are prohibited from parking in any areas other than those areas and locations which have been specifically designated by the WAA for their operations. No operator shall operate, stop or park a vehicle in a manner which blocks or interferes with traffic, both vehicle and pedestrian, while on Airport property. Class B Penalty 4.10 Ground transportation operators shall not dispose of garbage, papers, refuse, waste or other forms of trash, including debris, cigarettes, cigars, and matches on Airport property, except in receptacles provided for such purpose. Class C Penalty 4.11 Ground transportation operators or their passengers shall not ignite any smoking material, including but not limited to cigarettes or cigars, within any commercial ground transportation vehicle which is issued a commercial ground transportation operating permit and engages in commercial ground transportation services on Airport property. Class C Penalty 4.12 Ground transportation operators shall not sleep on Airport property, in vehicles or elsewhere, in an unprofessional, undignified or unseemly manner and as determined in the reasonable opinion of a law enforcement officer. Examples may include, but are not limited to: sleeping outside of the vehicle; sleeping stretched full-length in the vehicle front or back seat; feet, legs or head extended out a window; sleeping in a sleeping bag or under covering. Class C Penalty 4.13 Ground transportation operators may not sit upon, tamper with or manipulate airport fixtures, equipment or apparatus other than for their intended purpose. This sub-section includes the use of wheelchairs, except for the use of and/or when assisting persons with physical injuries, physical challenges or disabilities. Class C Penalty SECTION 5 MOTOR VEHICLE REQUIREMENTS 5.1 Condition of Vehicles. All motor vehicles shall be maintained in a good, safe, clean, and orderly condition at all times while engaged in commercial ground transportation services on Airport property, including, but not limited to, all of the following: 5.1.1 Operable rear-view mirrors.

An objectionable odor is defined as one that adversely affects an individual or individuals of normal sensibilities. 5.1.3 Paint must match (be of the same color, unless it is part of the design). 5.1.4 No visible exterior rust. 5.1.5 Free of major exterior body damage and cracks in the windshield greater than 1”. Vehicles with minor body damage may be allowed to continue operating at the discretion of the Director if it can be demonstrated to the Director that arrangements for repair have been made within a reasonable time period. “Major body damage” means substantial damage to a vehicle's fender(s), hood, quarter panel(s), door(s) or trunk lid. 5.1.6 Properly functioning headlights, tail lights, turn signals, brake lights, emergency flashers, and windshield wipers. 5.1.7 Properly functioning environmental control system (heat/air conditioning). 5.1.8 Properly functioning seatbelts/safety restraints for all seating positions, including the driver’s seat. 5.1.9 No fluid leaks of any kind (excluding the condensation caused by the air conditioner), nor any obvious pollution control problems. 5.1.10 Tires shall have a minimum tread depth of 3/32 inch, with no steel, wire, or other such reinforcing material visible. 5.1.11 Trunk areas are to be kept secure, clean, and available for storage of luggage. 5.1.12 Clean and tear-free interior. 5.1.13 Proper exhaust system, muffler. 5.1.14 Meet all other vehicle and safety standards as required by the Kansas Department of Motor Vehicle Code and state statute. Class C Penalty 5.2 All vehicles are to be maintained in a clean condition, both interior and exterior, free of any dirt or debris, except such as is normal due to certain weather conditions. Class C Penalty 5.3 All commercial ground transportation vehicles operating on Airport property shall be subject to routine and/or random inspections, performed by Wichita Police Officers, Airport Police and Fire Officers or other authorized officers of the City of Wichita and the Wichita Airport Authority, as deemed necessary to ensure compliance with these rules and regulations and the provisions of Chapters 3.84, 3.85, 3.88, and 9.35 of the Code of the City of Wichita. Compliance with the regulations, standards and provisions of this part, as well as Chapters 3.84, 3.85, 3.88, and 9.35 of the Code of the City of Wichita shall be applied and enforced jointly and collectively, or individually and exclusively by the Wichita Airport Authority and/or the City of Wichita for commercial ground transportation operations on Airport property.

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 17 of 22 Class B Penalty 5.3.1 Commercial transportation motor vehicles may be inspected at the time of initial or renewal application for permit/hang-tag and periodically thereafter by WAA personnel, and Wichita Police Department Officers to verify compliance with these rules and regulations and the requirements of the Code of the City of Wichita prior to issuance of an operating permit and hang-tag. 5.4 The City of Wichita Public Works and Utilities Department is responsible for inspection of all taxicabs permitted to operate within the City of Wichita, including on Airport property. Taxicab motor vehicle inspections for initial and renewal operating permits shall comply with Chapter 3.84.150 of the Code of the City of Wichita. Inspection decals or other proof acceptable to the WAA must be presented to the WAA upon application for initial or annual renewal operating permit. Operating permits shall not be issued prior to presenting proof of successful completion of a taxicab vehicle inspection. (Courtesy vehicle providers are exempt from this requirement.) SECTION 6 TAXICABS 6.1 Markings 6.1.1 Each taxicab shall have permanent markings on each side of the vehicle indicating at a minimum the taxicab company. Taxicab number shall be displayed on the rear of the vehicle at a minimum. Class C Penalty 6.1.2 Each taxicab shall have the published fares printed on each side of the vehicle and/or conspicuously displayed in the passenger compartment(s) of the vehicle. Class C Penalty 6.2 Staging/Queuing/Loading 6.2.1 Customer fare pick-up is on a first-come first-served basis. Vehicles shall stage/queue/load in the area indentified in APPENDIX B. The vehicle queued at the front of the queuing line shall serve the next available walk-up customer, regardless of the customer’s requested destination. As the vehicle leaves the queuing/loading area, the next vehicle in line shall move forward in the queue and be available for the next fare. All vehicles must advance to the next spot in the staging and/or queuing areas when the first vehicle in line departs. Any vehicle departing the queue line for any reason must re-enter the queue at the back of the line. Class B Penalty 6.2.2 The intent is for customers to use the (then current) first taxicab in the queue line, and consequently, for taxicab operators to accept the (then current) first customer in the queue line. However, customers have the right to select the next or other subsequent taxicabs in line at their sole option and discretion without obstruction, interference or recourse. Operators shall not have rights to pre-determine or pre-select customers, and if a potential customer will or will not receive services, based upon the destination. Class B Penalty

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 18 of 22 6.3 Regulation of Staging/Queuing/Loading Area 6.3.1 If staging and queuing spots are occupied or otherwise unavailable when an operator enters the staging/queuing area, the operator shall depart the area and return at a later time as queuing slots are available. Double parking in a queuing slot or parking in an area that is not designated as a taxicab queuing area is not permitted. Operators may park in any of the Airport paid parking lots to wait for queuing slot availability; however, the operator shall be responsible for any applicable parking fees. Class B Penalty 6.4 Taximeters. All taxicabs shall be equipped with a taximeter meeting the standards and requirements of Section 3.84.190 – Taximeters of the Code of the City of Wichita. Class A Penalty 6.5 Multiple Loading of Passengers – Shared Ride. Multiple loading of passengers is prohibited except in cases where the first customer engaging the taxicab requests multiple loading/shared fare, or agrees to multiple loading, and without suggestion or solicitation by the taxicab operator. The first customer/passenger/fare shall have exclusive use of the vehicle unless he or she agrees to multiple “shared fare” loading without direct or indirect suggestion or solicitation by the operator. Class B Penalty SECTION 7 LIMOUSINES AND SHUTTLES 7.1 Limousines. Except with the prior written authorization of the Director of Airports, all commercial limousine service shall be operated on a prearranged basis only. Except with the Director’s authorization, and based on the public demand for services and staging/queuing/loading space availability, all arrangements for limousine service shall be made prior to the vehicle entering into the commercial ground transportation staging/queuing/loading area of the Airport. Unless as specified in this part, a ground transportation operator offering limousine service shall not accept any customer on Airport property except those with whom service has been prearranged. At the permittee’s discretion, limousines may or may not have permanent markings on each side of the vehicle indicating the company name. At the sole discretion of and subject to prior approval of the WAA and the specific conditions of an operating permit, a “prearranged” service may also be defined as an arrangement or reservation for services from/at a leased ground transportation transaction counter within the airline passenger terminal. Class B Penalty 7.2 Shuttles. Commercial shuttle service is that used for the transportation of persons on a specified and published route and schedule. This transportation service may allow either “prearranged” and/or “on- demand” services. Shuttles shall have permanent markings on each side of the vehicle indicating the company name. Class B Penalty 7.3 Regulation of Staging/Loading Area 7.3.1 Limousines shall stage and load in the ground transportation loading area for minimum durations necessary only for business arrangements and passenger(s) and baggage loading.

Anticipated durations exceeding one-half (1/2) hour must be approved in advance by the Director. 7.3.2 Limousines and shuttles shall stage and load in designated areas as shown in APPENDIX B. Class B Penalty SECTION 8 COURTESY VEHICLES 8.1 Courtesy vehicle providers shall comply with the provisions of these rules and regulations as defined and applicable to such operations and activities. References made to “commercial ground transportation providers”, “permittees”, or “operators” shall have the same binding effect and shall be enforceable upon courtesy vehicle providers/operators in the same fashion as other commercial ground transportation permittees and operators defined in these regulations unless otherwise noted or specifically identified as excluded. 8.2 Courtesy vehicle service shall be operated on a prearranged basis only. Arrangements for courtesy vehicle service shall be made prior to the vehicle entering into the commercial ground transportation staging/loading area of the Airport. A service provider/operator offering courtesy transportation service shall not solicit or engage in ground transportation on Airport property for compensation or hire, gratuities excluded. Class B Penalty 8.3 Regulation of Staging/Loading Area 8.3.1 Courtesy vehicle shall pick up guests in designated areas as shown in APPENDIX B. Class B Penalty 8.3.2 Courtesy vehicle service providers/operators shall stage and load in the ground transportation loading area only for minimum durations necessary for passenger(s) and baggage loading. Such durations shall not exceed a maximum of one-half (1/2) hour. Anticipated durations exceeding one-half (1/2) hour must be approved in advance by the Director. Class B Penalty SECTION 9 NONREGISTERED OPERATORS AND SERVICES 9.1 Permit and Hang-Tag Not Required. The Director may authorize commercial ground transportation services to be provided from and upon Airport property without the requirement to hold a WAA issued commercial ground transportation operating permit and hang-tag. Examples of such cases may include, but are not limited to, out-of-town providers, motor coach charters, special events transportation, nonprofit, governmental or public transit, infrequent and irregular providers, or taxicabs, vans or limousines serving urgent or critical transportation demand. Infrequent and irregular providers are defined for these purposes as six (6) or less annual passenger(s) pick-up events. Urgent or critical transportation demand is defined as those circumstances in which a demand for transportation services exists beyond the capacity available at a given time, at an irregular hour critical demand, or when summoned by a representative of the WAA.

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 20 of 22 9.2 Except urgent or critical demand transportation, all nonregistered providers/operators and vehicles shall be operated on a prearranged basis only. Nonregistered providers/operators shall first obtain the Director’s prior authorization before engaging in commercial ground transportation customer pick-up on Airport property. All arrangements for transportation services shall be made prior to the vehicle entering upon Airport property. A nonregistered provider shall not accept any customer on Airport property except those for whom service has been prearranged. Nonregistered commercial ground transportation providers that do not hold a commercial operating permit with the WAA shall park their vehicle(s) in one of the revenue producing “paid” parking lots, or in a specific location as may be designated by the WAA. Nonregistered providers/operators shall not be entitled to access or operate within the commercial vehicle staging/queuing/loading area unless by prior approval of the WAA; such durations shall not exceed a maximum of one-half (1/2) hour unless approved in advance by the Director. Providers/operators may meet customers in the commercial passenger terminal building with a sign (if desired) meeting the requirements of these regulations. The WAA shall not waive or reimburse any parking fees. Class A Penalty 9.3 Nonregistered providers/operators and vehicles are specifically prohibited, either directly or indirectly, from soliciting, seeking, inquiring or otherwise engaging in commercial ground transportation passenger pick-up “back-haul” from Airport property following a passenger drop-off. Class A Penalty 9.4 Nonregistered providers/operators may unload passengers at the commercial passenger terminal public traffic lane(s), ticketing/departures curbside or other location specifically designated and marked for such purposes. Commercial ground transportation providers are not required to hold a permit with the Airport Authority solely for passenger drop-off. Class B Penalty SECTION 10 VIOLATIONS, PENALTIES, AND ENFORCEMENT 10.1 Violations 10.1.1 It is the goal of the Wichita Airport Authority to provide assistance, support, and resources to all permitted commercial ground transportation permittees and operators in providing safe, clean, efficient, and courteous ground transportation services to Airport patrons. It is the obligation and responsibility of the WAA to promulgate and enforce fair, reasonable, and nondiscriminatory commercial ground transportation rules and regulations. 10.1.2 Any violation of the rules and regulations outlined in this document may result in enforcement action taken against ground transportation permittees and/or operators singularly or collectively. The duration of sanctions and enforcement action(s) taken may depend on the class of violation, violation history, prior written warnings issued, circumstances involving the violation as described in this Section, or a combination thereof. 10.2 Penalties 10.2.1 Penalties for violation of these rules and regulations shall be categorized into three (3) types depending on the relative severity of the violation(s) and the previous history of violations of the same class. Penalties shall be grouped into Class A, B, or C category violations with the following commensurate and progressive penalties applied:

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 21 of 22 10.2.1.1 Class A Penalty First Offence 5 to 19 days suspension Second Offense 20 to 45 day suspension Third Offense Permanent revocation of permit 10.2.1.2 Class B Penalty First Offense 1 to 5 day suspension Second Offense 6 to 21 day suspension Third Offense 30 to 180 day suspension 10.2.1.3 Class C Penalty First Offense Written warning Second Offense 1 to 3 day suspension Third Offense 4 to 10 day suspension Fourth Offense 30 to 180 day suspension 10.2.2 When determining the duration of a penalty suspension, the second and subsequent penalty suspensions may be determined based on previous offenses of the same class. 10.3 Enforcement 10.3.1 The penalties set forth in this Section shall be applied and enforced upon commercial ground transportation permittees and/or operators who violate these rules and regulations. The specific length of penalty suspension shall be determined by either of the Director’s designees including the Assistant Director of Airports or the Chief of Airport Police and Fire. Copies of all written warnings, violations, penalty and enforcement history, and written witness and complaint statements shall remain on file with the Airport Authority for no more than five (5) years. All records on file are subject to review and reference when suspension violations are being considered. Copies of all official records shall be provided or made available on request to the Parking and Private Transportation Coordinator or other official designated to enforce the provisions of Chapters 3.84, 3.85, and 3.88 of the Code of the City of Wichita. 10.3.2 Airport Police and Fire Officers, Airport Services Officers, and Airport Operations Officers shall have the primary responsibility and authority to observe, inspect, investigate, take witness statements, question alleged violators, enforce penalty suspensions, and other such actions involving and associated with enforcement. The Director’s designated representatives including the Assistant Director of Airports and the Chief of Airport Police and Fire shall determine and assess suspension durations or revocations.

SOP #34 – Commercial Ground Transportation Procedures, Rules & Regulations | 16 Oct 2013 Page 22 of 22 10.3.3 When investigating reported or alleged violations, written witness and complaint statements of customers, tenant or Airport Authority employees, or other witnesses to alleged violation(s) may be evaluated and considered by the Director’s representative in determining factual content and circumstances of alleged violations. Alleged violators of rules and regulations also have the right to submit or cause to be submitted to the Director’s representative written witness statements which shall also be evaluated and considered. Alleged violators of rules and regulations shall also be provided copies of written witness and complaint statements upon request. 10.4 Appeals Process 10.4.1 A commercial ground transportation permittee and/or operator whose commercial operating privileges have been revoked or suspended on Airport property may appeal the violation and penalty to the Director of Airports in writing no later than three (3) business days after the date of the notice of suspension or revocation. The Director shall notify the appellant of his/her decision on the appeal in writing, and shall copy the City of Wichita Parking and Private Transportation Coordinator. 10.4.2 Further appeals may be made to the City Manager of the City of Wichita in writing, no later than five (5) business days after the notice of initial judgment has been received from the Director of Airports. The City Manager shall notify the appellant of the decision on the appeal in writing and shall copy the City of Wichita Parking and Private Transportation Coordinator or official designated to enforce these provisions and/or Chapters 3.84, 3.85, 3.88, and 9.35 of the Code of the City of Wichita. All decisions on appeals made by the City Manager are final. SECTION 11 ACKNOWLEDGMENT 11.1 As a condition of and prior to receiving a commercial operating permit, all commercial ground transportation permittees shall be required to sign an acknowledgment stating they have received and agree to comply with the Wichita Airport Authority Commercial Ground Transportation Procedures, Rules, and Regulations. 11.2 As a condition of and prior to receiving a hang-tag, all commercial ground transportation operators shall be required to sign an acknowledgment stating they have received and agree to comply with the Wichita Airport Authority Commercial Ground Transportation Procedures, Rules, and Regulations.

Page 3 of 5 Standard Operating Procedure No. 34, Appendix A-2 (Form Date 10-2013) Commercial Ground Transportation Operating Permit Self Authorization Form Driver’s License ____ All drivers to be utilized in Ground Transportation service by will be in possession of a valid Kansas Driver’s License for the type of vehicle Operated, and will be in compliance with all restrictions imposed on that license at all times. Driver Identification Badges ____All drivers to be utilized in Ground Transportation service by _______________________________, will be issued an Identification Badge (Badge) bearing a unique number, authorized by the Permit Holder. Each Badge will be assigned to only one individual driver for the Permit Holder, at any one time. *Please complete and submit Driver Information, Page 5. Each Badge must remain the property of the Permit Holder, and is to be returned immediately to the Permit Holder upon termination of the employee to whom it was assigned. Badges belonging to drivers that no longer work for Permit Holder may be reassigned to new employees. Vehicle Hang-tags ____Hang-tags will be numbered and issued to individual vehicles. Vehicle hang-tags must be immediately installed and may not be transferred from the vehicle to which they are assigned. Hang-tags are the sole property of the Authority and cannot be sold or conveyed to another party. Before a vehicle is allowed to use a hang tag for Wichita Mid- Continent Airport access, Permit Holder must identify the vehicle to which it will be assigned, and demonstrate proof of insurance acceptable to WAA. Should a new vehicle be added/removed from the Permit Holder’s fleet: Added: Permit Holder is required to notify WAA of changes at the time they occur. WAA will issue a new hang- tag to the vehicle. Removed: Hang-tags are the property of the WAA and are to be returned. Hang-tag assignment for new vehicles will be processed by the WAA.
