The right of a prospective rail service provider to restore active rail service in a rail banked corridor was most recently reaffirmed by the Surface Transportation Board (STB) in August 2005, as the STB responded to a petition from the Browns, Grayville & Poseyville Railway Company.

In California, the removal of rail track infrastructure from a rail banked corridor triggers requirements for a full environmental review, if and when an interested party seeks to replace the removed rails. No such restoration has ever occurred in California.
