The handout also suggests a sixth step that can be taken if the individual's appeal is denied "and you don't think the ADA paratransit eligibility process was fair." The authors also observe that "[t] o date, FTA has been more involved in pursuing violations of the eligibility process (for example, ensuring that transit agencies have a proper appeals process)
